TERMS AND CONDITIONS

of the online store “HSR-helmets”

(automotive – motorcycle accessories)

Effective from 14 January 2026.


Legal Basis:

  • Act of 30 May 2014 on Consumer Rights (Journal of Laws 2014, item 827) – note: the provisions of the Act of 30 May 2014 on Consumer Rights do not apply to contracts concluded outside the business premises if the consumer is obliged to pay an amount not exceeding fifty PLN.

  • Act of 18 July 2002 on the Provision of Electronic Services (Journal of Laws 2002 No. 144, item 1204, as amended).

  • Act of 16 July 2004 – Telecommunications Law (Journal of Laws 2004 No. 171, item 1800, as amended).

  • Act of 23 April 1964 – Civil Code (Journal of Laws 1964 No. 16, item 93, as amended).

  • Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws 1994 No. 24, item 83, as amended).

These Terms and Conditions [“Terms”] set out the rules and conditions for making purchases in the online store “HSR-helmets” [“eStore”], available at: http://hsr-helmets.pl/, in particular the rights and obligations of the Seller and Customers.


Definitions:

  • eStore – the online store available at http://hsr-helmets.pl/ together with its software.

  • eStore Website – the sales system hosted at http://hsr-helmets.pl/ including responsive subpages.

  • Seller – Entrepreneur Maciej Brzozowski, operating under the business name “MOTONITA Maciej Brzozowski”, located at Aleja Grunwaldzka 487B, 80-309 Gdańsk, registered in the Central Registration and Information on Business (CEIDG) in Poland, NIP: 6040242646, REGON: 526290611.

  • Customer – a consumer, a natural person with full legal capacity, or with the consent of a legal representative to enter into a binding sales contract, or an entrepreneur/legal entity that has accepted the Terms.

  • eStore Offer – products listed and described in the “Categories” sections on the eStore website – automotive/motorcycle accessories. The Seller takes all due care to ensure that the Offer is accurate, up-to-date, and reflects the actual condition.

  • Product – an item from the eStore Offer together with accompanying services, such as shipping, delivery, or collection.

  • Contract (of sale) – a sales contract for Products concluded remotely via electronic means between the Seller and the Customer. The Terms and applicable Polish law govern the contract. The language of the Contract is Polish.

  • eStore IT System – an IT system as defined in the Act of 18 July 2002 on the Provision of Electronic Services, consisting of interconnected IT devices and software, enabling the processing, storage, sending, and receiving of data via telecommunications networks using the appropriate terminal device.

  • Customer Account “My Account” – a dedicated memory space in the eStore IT system, identified by a unique login (Customer’s email address) and password, allowing the Customer convenient use of the eStore. Passwords are known only to the Customer, who is obliged to keep them confidential and protect against third-party access. Passwords may be changed at any time after the first successful login and can be recovered no more than once per day via the registered email address. Each Customer may create one Account.

  • Order – a statement of intent by the Customer specifying the quantity of Products and expressing the intention to conclude a sales Contract via the eStore IT system with the Seller.

Using the eStore, actively (e.g., placing an order) or passively (e.g., browsing pages), constitutes acceptance of the current Terms. Acceptance may also be expressed electronically during registration, which is required to make purchases.

These Terms are designed to protect the rights of Customers and ensure the highest quality of service. They are drafted clearly to reflect equal rights for the Seller and the Customer.

The Terms do not exclude or limit any rights of a Consumer arising from mandatory provisions of law. In the event of any conflict between these Terms and mandatory law, mandatory law prevails.

The Seller reserves the right to modify the Terms at any time, without retroactive effect. Changes take effect upon acceptance. Customers who do not accept the changes may notify the Seller. Contracts concluded before the changes remain governed by the Terms in effect at the time of Order placement.

These Terms are governed by Polish law, and any disputes fall under the jurisdiction of the competent Polish courts.


Customer obligations:

The Customer undertakes not to use the eStore IT System or its content for unlawful, harmful, fraudulent, or otherwise illegal purposes.

Copying, modifying, distributing, publicly displaying, reprinting, licensing, selling, exchanging, or transmitting materials and data from the eStore is protected under the Act of 4 February 1994 on Copyright and Related Rights and is strictly prohibited without written consent from the Seller.


Registration and Orders:

Registration in the eStore IT System is free and voluntary.

Registration is not required to make purchases but facilitates the process through a Customer Account.

Registration is performed online via https://hsr-helmets.pl/pl/reg or via Facebook.

During registration, the Customer must provide accurate, complete, and true data and set a password. After entering a valid email address, the Customer receives a confirmation email.

Customers may delete their Account at any time. For security, login credentials must not be shared, and logout is required after each session.

By registering, the Customer confirms that they have read and accept the Terms and Privacy Policy and agrees to comply unconditionally.

Customers may consent to the storage and processing of personal data for Order fulfillment or newsletters. Such consent is governed by the Act of 29 August 1997 on the Protection of Personal Data (Journal of Laws 1997, No. 133, item 883, as amended).


Purchase and Products:

The eStore sells automotive/motorcycle accessories. All Products are new, original, free of physical and legal defects, and legally introduced to the Polish market.

Placing an Order constitutes a legally binding offer to conclude a sales Contract. Orders may be placed via:

Orders can be placed 24/7, year-round.

Upon receipt of a valid Order, the Seller sends an automatic email with details: selected Products, quantity, price, delivery method, shipping address, and Order number.

Order processing begins upon receipt of payment via the available payment system. Standard Orders are processed within 24–48 hours after payment confirmation.

If the Product is unavailable or the Order cannot be fulfilled for other reasons, the Seller will inform the Customer via email, SMS, or telephone within 30 days of the Contract date.


Payments and Delivery:

Prices are gross, in Polish złoty (PLN), including VAT but excluding shipping.

The Seller issues a receipt or VAT invoice. Customers may consent to electronic invoices in any format via email.

Accepted payment methods:

The Seller may limit payment methods in exceptional cases.

Delivery is via DPD or InPost parcel lockers. Customers are advised to check packaging before acceptance; damage must be reported immediately.

Unless agreed otherwise, the delivery period is a maximum of 30 days from the Order date.


Right of Withdrawal:

Consumers may withdraw from a distance contract within 30 days without reason. The period starts from receipt of the Product or, in the case of services, from the contract conclusion date. Return costs are borne by the Customer.

Exemptions from withdrawal include: custom-made goods, perishable items, sealed goods that cannot be returned for health/hygiene reasons once opened, alcohol with delayed delivery, urgent repair services, digital content not on a tangible medium once performance starts with consent, and other statutory exemptions.

Returned Products must be sent at the Customer’s cost with a withdrawal statement and account details. Refunds are made within 30 days. Payment card refunds are credited to the original card.


Complaints:

Customers may submit complaints under warranty or statutory liability. Complaints are processed within 14 days. Written complaints should include the Customer’s name or company, address, complaint scope, details, and signature.

If the Product does not conform to the Contract, the Customer must submit a written claim specifying the discrepancy and expectations.

The Seller is not liable for defects caused by improper use. The statutory presumption period for defects is one year.


Exchange of Goods:

The Seller may allow exchange for a different size or color of the same model within 30 days of delivery. Products must be unused, with tags and accessories intact. One free exchange per product per Order; subsequent exchanges are charged to the Customer. Exchange rights do not limit statutory rights.


Additional Provisions:

The Seller is not liable for eStore disruptions due to force majeure, equipment failure, or third-party interference, nor for cyberattacks, hacking, or IT system failures of PayPal/Autopay. Temporary maintenance or system upgrades may occur with prior notification.

Using the eStore to distribute harmful software or spam is prohibited.
